SPONSOR: The AquaEars™ & EarPlanes™ We’re All Ears Sweepstakes (“Giveaway”) is sponsored by Cirrus Healthcare (“Sponsor”), distributor of EarPlanes™ and AquaEars™ products. EarPlanes™ are a patented, pressure-regulating earplug that help reduce discomfort often associated with pressure changes, such as during air travel. AquaEars™ are soft, silicone earplugs used to help protect the ears from water while swimming or bathing, as well as for noise reduction.  Both EarPlanes™ and AquaEars™ are backed by the Good Housekeeping Seal and available at stores nationwide.

This promotion is in no way sponsored, endorsed or administered by, or associated with Facebook. You understand that you are providing your information to Sponsor and not to Facebook when entering and when contacted for prize fulfillment. Information will not be shared or sold. 

ELIGIBILITY: The Giveaway is open to legal residents of the 50 United States and the District of Columbia, who are age 18 or older at the time of entry. Void where prohibited by law. Employees of the Sponsor, its parent company, subsidiaries, affiliated companies, advertising and promotion agencies, electronic media firm, Robin Leedy & Associates, Inc. (“Giveaway Administrator”), the immediate families of such employees (employees’ parents, siblings, children and spouses) and members of the same household of such employees, and anyone involved in the production, development or handling of this Giveaway are not eligible. All federal, state, and local laws and regulations apply. By entering, you verify that 1) you are 18 years of age or older, 2) an eligible US resident and 3) you are giving the Sponsor permission to contact you should you be randomly selected.

PHOTO ELIGIBILITY: By submitting a photograph, the entrant certifies that:  1) entrant is older than 18 years of age; 2) entrant owns the copyright to the photograph and agrees to grant the Sponsor and Administrator exclusive, worldwide, royalty-free, perpetual and irrevocable right and license to copy, reproduce, publish in any media, distribute, and display all submitted photos, images, and text. 
Entrants accept this when submitting,  but this does not automatically approve the photo entry, which is at the sole discretion of the Giveaway Administrator.  The photo submission must meet the specific Photo Eligibility guidelines below: 

•	Must be an original photo; unaltered/unedited photos only.
•	Subject(s) in the photo should be featured without any other identifiable logos or signage.
•	It must be a picture of which you own the full rights;  no professional photography, stock photography or other photograph (e.g., image found on Google Images) will be accepted.
•	Photos must clearly display the subject of ears.
•	You must be 18 years of age in the photo. If there is a child/ren in the photo, you must be the parent/legal guardian of all human subject(s) in the photo in order to submit the photo.  Photos which contain children of which you are not the parent/legal guardian will be disqualified. 
•	Photos that do not meet these criteria will not be accepted into the sweepstakes, and entrants of non-eligible photos will not be notified that their photo did not meet the criteria for entry.

The Sponsor and Administrator reserve the right to alter pictures and edit text, and to remove or reject any submissions at any time for any reason. Entrants not meeting the outlined criteria will be automatically disqualified. 

If selected as a random winner, upon Sweepstakes Administrator’s request, the entrant may be asked to prove ownership of entry photograph by providing to the Administrator two (2) additional images of the subject depicted in the entry photograph within two (2) business days of request. Administrator will contact winner via the email address provided on the official entry form. If winner does not comply with outlined parameters, their entry will be considered ineligible and a new random winner will be selected from all eligible entries.

HOW TO ENTER:  Submit entry as instructed per the entry form via the Votigo Application (“Sweepstakes Website”).

All eligible entries must include a photograph that meet the guidelines. Eligible entrants must meet parameters outlined in the ELIGIBILITY section of OFFICIAL RULES. The entry period begins on February 20, 2014 at 4 p.m. EST and ends April 25, 2014 at 4 p.m.  EST.  Five (5) entrants will be randomly selected monthly on February 28th, 2014; March 28th, 2014; and  April 25th, 2014 @ 4 p.m. EST from all eligible entrants at the time of winner selection.  

Five (5) winners will receive one (1) pair of EarPlanes™ for Kids, one (1) pair of EarPlanes™, one (1) pair of AquaEars™ and one (1) $25 gift card to Cirrus Healthcare retailer CVS. Prize products may vary and may be substituted at the Administrator’s discretion. 

Limit of one entry per person, household, or email address. Multiple registrations from the same entrant may result in ineligibility to receive a prize. All entry periods are in Eastern Time unless otherwise noted. Administrator’s computer is the official time-keeping device for Sweepstakes. Sponsor is not responsible for incomplete or incorrect mailing addresses or invalid entries. Sponsor reserves the right to delete responses that are considered spam and/or are considered abusive, defamatory or obscene. All entry information collected becomes the sole property of the Sponsor and will not be shared or sold.

PRIZES: Five monthly prize packs for three months will each include one (1) box of EarPlanes™ pressure-regulating earplugs for adults, one (1) box of EarPlanes™ pressure-regulating earplugs kids, one (1) box of AquaEars™  silicon water and noise protection earplugs, and one (1) $25 gift card to CVS, a retailer of both EarPlanes™ and AquaEars™ products. Value of each individual prize package is $52.97.

Total prize value of all fifteen (15) prizes is approximately $794.55 USD plus shipping and handling depending on winner location.
Any expenses not mentioned above are the winner’s responsibility. If applicable, taxes are the winner’s responsibility. Prizes are not transferable or redeemable for cash. No substitution for prize except as may be necessary due to unavailability, in which case a prize of equal or greater value will be awarded at the Sponsor’s sole discretion. Prizes may vary in color, size, and other respects from items shown on Sweepstakes Website. Odds of winning depend upon the number of entries received at the time of winner selection.

WINNERS: Winners will be notified by email, by having the prize mailed to the address supplied on the Giveaway entry form and via an announcement of the prize winners on the EarPlanes™ & AquaEars™ Facebook pages (www.facebook.com/earplanes and www.facebook.com/aquaears). No other notification will be provided. Winners will be determined by the Sweepstakes administrator, Robin Leedy & Associates, Inc., whose decisions regarding this Sweepstakes are final. Limit of one prize per household. Any prize returned as undeliverable will be awarded to an alternate winner. Except where prohibited by law, acceptance of a prize shall constitute and signify the winner's consent that the Sponsor may use the winner's name, address (city and state only), likeness, photos submitted and any written statements made by the winner about the Sweepstakes and Sponsor for promotional purposes, in all forms of media, including online on Facebook, Twitter, etc., in perpetuity and without monetary payment or additional consideration.

GENERAL TERMS: Entrants agree to be bound by these Official Rules. Participants, in this Giveaway, hereby waive and release, and agree to hold harmless Facebook® and the Giveaway Sponsor, its parent, subsidiaries, affiliates, advertising and promotion agencies, Robin Leedy & Associates, Inc., and all of their respective officers, directors, employees, representatives and agents, from and against, any and all rights, claims and causes of action whatsoever that they may have, or which may arise, against any of them for any liability for any matter, cause of thing whatsoever, including but not limited to any injury, loss, damage, whether direct, compensatory, incidental or consequential, to person, including death and property, arising in whole or in part, directly or indirectly, from their acceptance, possession, use or misuse of, or inability to use a prize in the Giveaway, or their participation in the Giveaway, or their participation in any Giveaway or prize related activity. Participants acknowledge that the Sponsor and other released entities and individuals have neither made, nor are in any manner responsible or liable for any warranty, representation, or guarantee, expressed or implied, in fact or in law, relative to the prize, including but not limited to its quality, mechanical condition, or fitness, except for any standard limited warranty offered by any manufacturer of the non-cash prize.

INTERNET: Sponsor and its agents are not responsible for lost, late, misdirected, damaged, incomplete or illegible entries or Internet technical, hardware, software, telephone, or transmission failures of any kind, which may limit a person’s ability to enter the Giveaway. Sponsor and its agents are not responsible for any injury or damage to entrants’ or any other person’s computer related to or resulting from entering or downloading any materials in the Giveaway. Sponsor reserves the right to cancel or suspend advertising the Giveaway on the Internet should a computer virus, unauthorized intervention or other cause corrupt the integrity or proper conduct of the Giveaway. Sponsor reserves the right to disqualify any entrant found to be disrupting the operation of the Giveaway or Giveaway Website. If the integrity of the Internet portion of the Giveaway is compromised in any manner, Sponsor reserves the right to modify Giveaway and randomly select winners from valid entries received that are unaffected by the problem. In the event of a dispute as to the identity of any online entrant, entrant will be deemed the individual named on the online entry. All issues and questions concerning these Official Rules, or the rights and obligations of the entrant and Sponsor in connection with the Giveaway, shall be governed by, and construed in accordance with, the laws of the state of New York, without giving effect to any choice of law or conflict of law rules (whether of New York or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than New York. WARNING: ANY ATTEMPT BY A PARTICIPANT TO DELIBERATELY DAMAGE THE SPONSOR OR SPONSOR’S WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE GIVEAWAY MAY BE IN VIOLATION OF CRIMINAL AND CIVIL LAWS, AND SHOULD SUCH AN ATTEMPT BE MADE, THE SPONSOR RESERVES THE RIGHT TO SEEK REMEDIES AND DAMAGES (INCLUDING ATTORNEYS’ FEES) FROM ANY SUCH PARTICIPANT TO THE FULLEST EXTENT OF THE LAW, INCLUDING CRIMINAL PROSECUTION.

APPLICABLE LAWS AND JURISDICTION: With respect to any dispute regarding the Giveaway, your rights and obligations and actions shall be governed by the laws of New York, as if the rules were a contract wholly entered into and wholly performed within New York. Any dispute relating in any way to your participation in the Giveaway shall be submitted to confidential arbitration in New York. Arbitration under this agreement shall be conducted under the rules then prevailing of the American Arbitration Association. The arbitrator's award shall be binding and may be entered as a judgment in any court of competent jurisdiction. To the fullest extent permitted by applicable law, no arbitration under this Agreement shall be joined to or consolidated with an arbitration involving any other party subject to this Agreement, whether through class arbitration proceedings or otherwise.
