This promotion is in no way sponsored, endorsed or administered by, or associated with, Facebook®. You understand that you are providing your information to the Sponsor and not to Facebook when entering and when contacted for prize fulfillment. Information will not be shared or sold.  Any questions, comments or complaints regarding this Giveaway shall be directed to Sponsor and not to Facebook.
ELIGIBILITY: The Giveaway is open to legal residents of the 50 United States and the District of Columbia who are age 18 or older at the time of entry. Void where prohibited by law. Employees of the Sponsor, its parent company, subsidiaries, affiliated companies, advertising and promotion agencies, electronic media firm, Robin Leedy & Associates, Inc. (“Giveaway Administrator”), the immediate families of such employees (employees’ parents, siblings, children and spouses) and members of the same household of such employees, and anyone involved in the production, development or handling of this Giveaway are not eligible. All federal, state, and local laws and regulations apply. 

By submitting a photograph, the entrant certifies that:  1) entrant is older than 18 years of age; 2) entrant owns the copyright to the photograph and agrees to grant the Sponsor exclusive, worldwide, royalty-free, perpetual and irrevocable right and license to copy, reproduce, publish in any media, distribute, and display all submitted photos, images, and text; 3) entrant is an eligible US resident; 4) entrant gives the Sponsor permission to contact he/she should he/she be randomly selected. Entrants must accept this on the Official Entry form to be considered for entry eligibility, but this does not automatically approve the photo entry.  The photo submission must also meet our Photo Eligibility guidelines below. 

PHOTO CRITERIA/ELIGIBILITY: 
•	Photos must clearly display the subject of your #BeActiv goal (either entrant in action or a photo representing how he/she plans to #BeActiv);
•	Subject(s) in the photo should be featured without any other identifiable brand logos or signage (e.g., logos on shirts, etc.);
•	It must be a picture entrant owns the full rights to, no professional or watermarked photography will be accepted;
•	If there is a human subject featured, the photo must only include the person entering; photos with more than one person other than the entrant will not be accepted, since Sponsor or entrant does not have the written consent of this other individual(s);
•	Photos cannot contain any nudity or content considered obscene/explicit.

Photos that do not meet these and other criteria will not be accepted into the sweepstakes, and entrants of non-eligible/disqualified photos will not be notified that their photo did not meet the criteria for entry. The Sponsor and Administrator reserve the right to alter pictures and edit text, and to remove or reject any submissions at any time for any reason. Entrants not meeting the outlined criteria will be disqualified. 
If selected as a random winner, upon Sweepstakes Administrator’s request, the entrant may be asked, upon the administrator’s discretion, to prove ownership of entry photograph by providing to the Administrator two (2) additional images of the subject depicted in the entry photograph within two (2) business days of request. Administrator will contact winner via the email address provided on the official entry form and with an announcement on the Viactiv Facebook page (www.facebook.com/viactiv). If winner does not comply with outlined parameters, their entry will be considered ineligible and a new random winner will be selected from all eligible entries.

HOW TO ENTER: Submit entry as instructed per the entry form via the Votigo Application (“Sweepstakes Website”).
All eligible entries must include a photograph that meets the guidelines. 
The entry period begins on January 26, 2015, at 12 p.m.  ET and ends February 27, 2015, at 12 p.m. ET.  Limit of one entry per person, household, or email address. Multiple registrations from the same entrant may result in ineligibility to receive a prize. All entry periods are in Eastern Time unless otherwise noted. Administrator’s computer is the official time-keeping device for Sweepstakes. Sponsor is not responsible for incomplete or incorrect mailing addresses or invalid entries. Sponsor reserves the right to delete responses that are considered spam and/or are considered abusive, defamatory or obscene. All entry information collected becomes the sole property of the Sponsor and will not be shared or sold.

PRIZES (28 total winners): 
•	One grand prize winner:  $1,000 American Express® gift card plus the complete Viactiv® calcium product line (prize value of $1040.46)
•	Two runner up winners: $500 American Express® gift card (each) plus the complete Viactiv® calcium product line (prize value  of $540.46 each)
•	25 bonus winners/5 winners per week: FitBit® Flex Wireless Activity & Sleep Wristband ($99.99 ARV each) plus entrants choice of Viactiv® calcium supplement product chosen on the official entry form ($8.99-$12.49 ARV each depending on product choice)
Total prize value is approximately $4,933.38 plus shipping and handling depending on winner location in the United States. Odds of winning depend upon the number of entries received at the time of random winner selection. All prizing offered will be awarded. 

Five weekly prize winners awarded the FitBit® and choice of Viactiv product each Friday during the sweepstakes (at or around 12 pm ET each Friday).  The grand prize winner and two runner-up winners will be randomly selected from all eligible entries on the final day, 2/27/15, at or around 12 p.m. ET.  The first random winner selected on 2/27/15 will be awarded the grand prize, the next two selected randomly will get the two runner-up prizes and the five random winners selected after this will receive the last five FitBit® prize packages, in this order specifically for the final seven winners.
Any expenses not mentioned above are the winner’s responsibility. If applicable, taxes are the winner’s responsibility. Prizes are not transferable or redeemable for cash. No substitution for prize except as may be necessary due to unavailability, in which case a prize of equal or greater value will be awarded at the Sponsor’s sole discretion. Prizes may vary in size and other respects from items shown on Sweepstakes website. Odds of winning depend upon the number of entries received at the time of random winner selection.

WINNERS: Winners will be notified via email to the address provided on the official entry form, by announcement on the Viactiv® Facebook page (https://www.facebook.com/viactiv) and by having the prize mailed to the address (no PO boxes accepted) supplied on the Giveaway entry form. No other notification will be provided. If this address is in an area where this Giveaway was void by law or outside of the United States, this winner will be considered ineligible and a new winner will be randomly selected for that Giveaway prize. Winners can expect to receive their prize within four (4) weeks following the Giveaway end date of 2/27/15 or sooner at Sponsor’s discretion. If requested, winners are required to respond to email notification or photo validation for prizing confirmation. If Sponsor is unable to contact a potential winner within five (5) business days, or in the event that a prize notification or prize is returned undeliverable, the prize may be forfeited and, at the Sponsor’s sole discretion, prize may be awarded to an alternate Winner selected in a random drawing from all remaining eligible entries received.  
Winners will be randomly determined by the Giveaway Administrator, whose decisions regarding this Giveaway are final. Except where prohibited by law, acceptance of a prize shall constitute and signify the winner’s consent that the Sponsor may use the winner’s name, address (city and state only), likeness and any statements made by the winner about the Giveaway and Sponsor for promotional purposes, in all forms of media, including online on the Sponsor’s website or those operated by the Sponsor now or in the future (e.g.  Facebook, Twitter, etc.) , in perpetuity and without monetary payment or additional consideration.

GENERAL TERMS: Entrants agree to be bound by these Official Rules. Participants, in this Giveaway, hereby waive and release, and agree to hold harmless Facebook, Giveaway Administrator, Sponsor, its parent, subsidiaries, affiliates, advertising and promotion agencies, and all of their respective officers, directors, employees, representatives and agents, from and against, any and all rights, claims and causes of action whatsoever that they may have, or which may arise, against any of them for any liability for any matter, cause of thing whatsoever, including but not limited to any injury, loss, damage, whether direct, compensatory, incidental or consequential, to person, including death and property, arising in whole or in part, directly or indirectly, from their acceptance, possession, use or misuse of, or inability to use a prize in the Giveaway, or their participation in the Giveaway, or their participation in any Giveaway or prize related activity. Participants acknowledge that the Sponsor and other released entities and individuals have neither made, nor are in any manner responsible or liable for any warranty, representation, or guarantee, expressed or implied, in fact or in law, relative to the prize, including but not limited to its quality, mechanical condition, or fitness, except for any standard limited warranty offered by any manufacturer of the non-cash prize.

INTERNET: Sponsor and its agents are not responsible for lost, late, misdirected, damaged, incomplete or illegible entries or Internet technical, hardware, software, telephone, or transmission failures of any kind, which may limit a person’s ability to enter the Giveaway. Sponsor and its agents are not responsible for any injury or damage to entrants’ or any other person’s computer related to or resulting from entering or downloading any materials in the Giveaway. Sponsor reserves the right to cancel or suspend advertising the Giveaway on the Internet should a computer virus, unauthorized intervention or other cause corrupt the integrity or proper conduct of the Giveaway. Sponsor reserves the right to disqualify any entrant found to be disrupting the operation of the Giveaway or Giveaway Website. If the integrity of the Internet portion of the Giveaway is compromised in any manner, Sponsor reserves the right to modify Giveaway and randomly select winners from valid entries received that are unaffected by the problem. In the event of a dispute as to the identity of any online entrant, entrant will be deemed the individual named on the online entry. All issues and questions concerning these Official Rules, or the rights and obligations of the entrant and Sponsor in connection with the Giveaway, shall be governed by, and construed in accordance with, the laws of the state of CT, without giving effect to any choice of law or conflict of law rules (whether of CT or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than CT. WARNING: ANY ATTEMPT BY A PARTICIPANT TO DELIBERATELY DAMAGE THE SPONSOR OR SPONSOR’S WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE GIVEAWAY MAY BE IN VIOLATION OF CRIMINAL AND CIVIL LAWS, AND SHOULD SUCH AN ATTEMPT BE MADE, THE SPONSOR RESERVES THE RIGHT TO SEEK REMEDIES AND DAMAGES (INCLUDING ATTORNEYS’ FEES) FROM ANY SUCH PARTICIPANT TO THE FULLEST EXTENT OF THE LAW, INCLUDING CRIMINAL PROSECUTION.
APPLICABLE LAWS AND JURISDICTION: With respect to any dispute regarding the Giveaway, your rights and obligations and actions shall be governed by the laws of CT, as if the rules were a contract wholly entered into and wholly performed within CT. Any dispute relating in any way to your participation in the Giveaway shall be submitted to confidential arbitration in CT. Arbitration under this agreement shall be conducted under the rules then prevailing of the American Arbitration Association. The arbitrator's award shall be binding and may be entered as a judgment in any court of competent jurisdiction. To the fullest extent permitted by applicable law, no arbitration under this Agreement shall be joined to or consolidated with an arbitration involving any other party subject to this Agreement, whether through class arbitration proceedings or otherwise.
