SPONSOR: The SayAhh!® “Cold Season Survival Stash” Sweepstakes (“Giveaway”) is sponsored by Q-In Medical Technologies, LLC (“Sponsor”), distributor of the SayAhh!® Sore Throat Home Exam Aid.

This Giveaway is in no way sponsored, endorsed, administered by, or associated with, Facebook or American Express.  You understand that you are providing your information to the Sponsor and not to Facebook when entering and when contacted for product fulfillment. Information will not be shared or sold.  

ELIGIBILITY: The Giveaway is open to legal residents of the 50 United States and the District of Columbia who are age 18 or older at the time of entry. Void where prohibited by law. Employees of the Sponsor, its parent company, subsidiaries, affiliated companies, advertising and promotion agencies, electronic media firm, Robin Leedy & Associates, Inc. (“Giveaway Administrator”), the immediate families of such employees (employees’ parents, siblings, children and spouses) and members of the same household of such employees, and anyone involved in the production, development or handling of this Giveaway are not eligible. All federal, state, and local laws and regulations apply. By entering, you verify that you are 18 years of age or older, an eligible U.S. resident and you are giving the Sponsor permission to contact you should regarding the giveaway offer.   

HOW TO ENTER: Submit information as instructed per the entry form via the Official Entry Form Application (“Giveaway Website”).  The Giveaway sign up period begins on Monday, August 24, 2015, at 11 a.m. ET, and ends on Friday, September 18, 2015, at 11 a.m. ET.  Fifteen (15) random winners will be selected from all eligible entries for the prize and notified via the email provided on the entry form.  The prize will be mailed out within four to six weeks, or sooner at the discretion of the Giveaway Administrator. 
Limit of one entry per person, household and/or email address. Tampering and/or multiple registrations from the same entrant may result in ineligibility to receive the product. All entry periods are in Eastern Time unless otherwise noted. Sponsor reserves the right to delete entries that are considered spam or are no eligible based on the Official Rules. Administrator’s computer is the official time-keeping device for Giveaway. Sponsor is not responsible for incomplete or incorrect mailing addresses or invalid entries. All entry information collected becomes the sole property of the Sponsor and will not be shared or sold. Only those who opt-in for future contact from the company will be saved.

All giveaway signups will receive at least one post-signup email alerting them to the status of this giveaway offer.  Only those who opt-in for future brand/company contact will/may be emailed additionally in the future.

PRIZE:  Fifteen (15) random winners will be chosen and will each receive a $25 American Express gift card ($375.00 total for all gift cards), plus shipping and handling depending on mailing location in the United States.  *If the SayAhh! Facebook page (www.Facebook.com/SayAhhforMoms) reaches 1,500 fan LIKES by the end of the giveaway entry period, then an additional winner (1) will be randomly chosen to  receive a $200 American Express gift card as the Grand Prize Winner.* 

Any expenses not mentioned above are the winner’s responsibility. If applicable, taxes are the winner’s responsibility. Product is not transferable or redeemable for cash. No substitution except as may be necessary due to unavailability, in which case an item of equal or greater value will be provided at the Sponsor’s sole discretion. 

Prize recipients are determined randomly from all eligible entries by the Giveaway Administrator, whose decisions regarding this matter are final. Limit of one product per household. Any product returned unopened or undelivered will be sent to the next alternate recipient(s). Except where prohibited by law, acceptance of a product shall constitute and signify the recipient’s consent that the Sponsor may use the recipient’s name, address (city and state only), and likeness and any written statements made by the recipient about the Giveaway and Sponsor for promotional purposes, in all forms of media, in perpetuity and without monetary payment or additional consideration.

Recipients will be notified via email to the address provided on the official entry form and by having the product mailed to the address (no PO boxes accepted) supplied on the entry form. No other notification will be provided. If this address is in an area where this Giveaway was void by law or outside of the United States, is a PO Box, or is incomplete in any way on the entry form, this winner will be considered ineligible and a new recipient will be randomly selected.  

GENERAL TERMS: Entrants agree to be bound by these Official Rules. Participants in this Giveaway, hereby waive, release, and agree to hold harmless Facebook®, American Express, and the Giveaway Sponsor, its parent company, its subsidiaries, affiliates, advertising and promotion agencies, and all of their respective officers, directors, employees, representatives and agents, from and against, any and all rights, claims and causes of action whatsoever that they may have, or which may arise, against any of them for any liability for any matter, cause of thing whatsoever, including but not limited to any injury, loss, damage, whether direct, compensatory, incidental or consequential, to person, including death and property, arising in whole or in part, directly or indirectly, from their acceptance, possession, use or misuse of, or inability to use the Giveaway, or their participation in the Giveaway, or their participation in any Giveaway-related activity. Participants acknowledge that the Sponsor and other released entities and individuals have neither made, nor are in any manner responsible or liable for any warranty, representation, or guarantee, expressed or implied, in fact or in law, relative to the giveaway, including but not limited to its quality, mechanical condition, or fitness, except for any standard limited warranty offered by any manufacturer of the non-cash prize.

INTERNET: Sponsor and its agents are not responsible for lost, late, misdirected, damaged, incomplete or illegible entries or Internet technical, hardware, software, telephone, or transmission failures of any kind, which may limit a person’s ability to enter the Giveaway. Sponsor and its agents are not responsible for any injury or damage to entrants’ or any other person’s computer related to or resulting from entering or downloading any materials in the Giveaway. Sponsor reserves the right to cancel or suspend advertising the Giveaway on the Internet should a computer virus, unauthorized intervention or other cause corrupt the integrity or proper conduct of the Giveaway. Sponsor reserves the right to disqualify any entrant found to be disrupting the operation of the Giveaway or Giveaway Website. If the integrity of the Internet portion of the Giveaway is compromised in any manner, Sponsor reserves the right to modify Giveaway and select product recipients, in order, from valid entries received that are unaffected by the problem. In the event of a dispute as to the identity of any online entrant, entrant will be deemed the individual named on the online entry. All issues and questions concerning these Official Rules, or the rights and obligations of the entrant and Sponsor in connection with the Giveaway, shall be governed by, and construed in accordance with, the laws of New Hampshire, without giving effect to any choice of law or conflict of law rules (whether of New Hampshire or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than New Hampshire. WARNING: ANY ATTEMPT BY A PARTICIPANT TO DELIBERATELY DAMAGE THE SPONSOR OR SPONSOR’S WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE GIVEAWAY MAY BE IN VIOLATION OF CRIMINAL AND CIVIL LAWS, AND SHOULD SUCH AN ATTEMPT BE MADE, THE SPONSOR RESERVES THE RIGHT TO SEEK REMEDIES AND DAMAGES (INCLUDING ATTORNEYS’ FEES) FROM ANY SUCH PARTICIPANT TO THE FULLEST EXTENT OF THE LAW, INCLUDING CRIMINAL PROSECUTION.

APPLICABLE LAWS AND JURISDICTION: With respect to any dispute regarding the Giveaway, your rights and obligations and actions shall be governed by the laws of New Hampshire, as if the rules were a contract wholly entered into and wholly performed within New Hampshire. Any dispute relating in any way to your participation in the Giveaway shall be submitted to confidential arbitration in New Hampshire. Arbitration under this agreement shall be conducted under the rules then prevailing of the American Arbitration Association. The arbitrator's award shall be binding and may be entered as a judgment in any court of competent jurisdiction. To the fullest extent permitted by applicable law, no arbitration under this Agreement shall be joined to or consolidated with an arbitration involving any other party subject to this Agreement, whether through class arbitration proceedings or otherwise.
