SPONSOR: The Stopain® Migraine Sample Giveaway (“Giveaway”) is sponsored by Troy Healthcare, LLC (“Sponsor”), distributor of Stopain® topical pain relief products.

This Giveaway is in no way sponsored, endorsed, administered by, or associated with, Facebook.  You understand that you are providing your information to the Sponsor and not to Facebook when entering and when contacted for sample fulfillment. Information will not be shared or sold.  While Walmart® is mentioned in conjunction with the sample giveaway and the Stopain® Migraine product, it is not a sponsor of this giveaway.

ELIGIBILITY: The Giveaway is open to legal residents of the 50 United States and the District of Columbia who are age 18 or older at the time of entry. Void where prohibited by law. Employees of the Sponsor, its parent company, subsidiaries, affiliated companies, advertising and promotion agencies, electronic media firm, Robin Leedy & Associates, Inc. (“Giveaway Administrator”), the immediate families of such employees (employees’ parents, siblings, children and spouses) and members of the same household of such employees, and anyone involved in the production, development or handling of this Giveaway are not eligible. All federal, state, and local laws and regulations apply. By entering, you verify that you are 18 years of age or older, an eligible U.S. resident and you are giving the Sponsor permission to contact you should regarding the sample offer.   

HOW TO ENTER: Submit information as instructed per the entry form via the Official Entry Form Application (“Giveaway Website”).  The Giveaway sign up period begins on Monday, May 11, 2015, at 9 a.m. ET, and ends on Friday, May 22, 2015, at 5 p.m. ET.  The first two thousand  five hundred (2,500) eligible sign-ups will be selected for the sample offer and notified via the email provided on the entry form on or before Friday, May 29, 2015, at 5 p.m. ET.  Samples will be mailed out within four to six weeks, or sooner at the discretion of the Giveaway Administrator.  Those who are eligible sample sign ups, but who were not one of the first 2,500 to receive the sample, may be sent an additional offer via email at the discretion of the Sponsor. 

Limit of one entry per person, household and/or email address. Tampering and/or multiple registrations from the same entrant may result in ineligibility to receive the sample. All entry periods are in Eastern Time unless otherwise noted. Sponsor reserves the right to delete entries that are considered spam. Administrator’s computer is the official time-keeping device for Giveaway. Sponsor is not responsible for incomplete or incorrect mailing addresses or invalid entries. All entry information collected becomes the sole property of the Sponsor and will not be shared or sold. Only those who opt-in for future contact from the company will be saved.

All sample signups will receive at least one post-signup email alerting them to the status of this sample offer.  Only those who opt-in for future brand/company contact will/may be emailed additionally in the future.

SAMPLE GIVEAWAY VALUE: The value of each Stopain® Migraine sample mailer (which contains one dose of Stopain Migraine)  is approximately $.30 USD each ($750 total for all samples), plus shipping and handling depending on mailing location in the United States. Each recipient (2,500 total recipients) will get a single-dose sample by mail. Any expenses not mentioned above are the winner’s responsibility. If applicable, taxes are the winner’s responsibility. Samples are not transferable or redeemable for cash. No substitution except as may be necessary due to unavailability, in which case an item of equal or greater value will be provided at the Sponsor’s sole discretion. 

Sample recipients will be the first 2,500 eligible sign ups and determined by the Giveaway Administrator, whose decisions regarding this matter are final. Limit of one sample per household. Any sample returned unopened or undelivered will be sent to the next alternate recipient(s). Except where prohibited by law, acceptance of a sample shall constitute and signify the recipient’s consent that the Sponsor may use the recipient’s name, address (city and state only), and likeness and any written statements made by the recipient about the Giveaway and Sponsor for promotional purposes, in all forms of media, in perpetuity and without monetary payment or additional consideration.

Recipients will be notified via email to the address provided on the official entry form and by having the sample mailed to the address (no PO boxes accepted) supplied on the entry form. No other notification will be provided. If this address is in an area where this Giveaway was void by law or outside of the United States, or is incomplete on the entry form, this winner will be considered ineligible and a new recipient will be selected in order of entry.  

GENERAL TERMS: Entrants agree to be bound by these Official Rules. Participants in this Giveaway, hereby waive, release, and agree to hold harmless Facebook® and the Giveaway Sponsor, its parent company, its subsidiaries, affiliates, advertising and promotion agencies, and all of their respective officers, directors, employees, representatives and agents, from and against, any and all rights, claims and causes of action whatsoever that they may have, or which may arise, against any of them for any liability for any matter, cause of thing whatsoever, including but not limited to any injury, loss, damage, whether direct, compensatory, incidental or consequential, to person, including death and property, arising in whole or in part, directly or indirectly, from their acceptance, possession, use or misuse of, or inability to use the Giveaway, or their participation in the Giveaway, or their participation in any Giveaway-related activity. Participants acknowledge that the Sponsor and other released entities and individuals have neither made, nor are in any manner responsible or liable for any warranty, representation, or guarantee, expressed or implied, in fact or in law, relative to the giveaway, including but not limited to its quality, mechanical condition, or fitness, except for any standard limited warranty offered by any manufacturer of the non-cash prize.

INTERNET: Sponsor and its agents are not responsible for lost, late, misdirected, damaged, incomplete or illegible entries or Internet technical, hardware, software, telephone, or transmission failures of any kind, which may limit a person’s ability to enter the Giveaway. Sponsor and its agents are not responsible for any injury or damage to entrants’ or any other person’s computer related to or resulting from entering or downloading any materials in the Giveaway. Sponsor reserves the right to cancel or suspend advertising the Giveaway on the Internet should a computer virus, unauthorized intervention or other cause corrupt the integrity or proper conduct of the Giveaway. Sponsor reserves the right to disqualify any entrant found to be disrupting the operation of the Giveaway or Giveaway Website. If the integrity of the Internet portion of the Giveaway is compromised in any manner, Sponsor reserves the right to modify Giveaway and select sample recipients, in order, from valid entries received that are unaffected by the problem. In the event of a dispute as to the identity of any online entrant, entrant will be deemed the individual named on the online entry. All issues and questions concerning these Official Rules, or the rights and obligations of the entrant and Sponsor in connection with the Giveaway, shall be governed by, and construed in accordance with, the laws of PA, without giving effect to any choice of law or conflict of law rules (whether of PA or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than PA. WARNING: ANY ATTEMPT BY A PARTICIPANT TO DELIBERATELY DAMAGE THE SPONSOR OR SPONSOR’S WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE GIVEAWAY MAY BE IN VIOLATION OF CRIMINAL AND CIVIL LAWS, AND SHOULD SUCH AN ATTEMPT BE MADE, THE SPONSOR RESERVES THE RIGHT TO SEEK REMEDIES AND DAMAGES (INCLUDING ATTORNEYS’ FEES) FROM ANY SUCH PARTICIPANT TO THE FULLEST EXTENT OF THE LAW, INCLUDING CRIMINAL PROSECUTION.

APPLICABLE LAWS AND JURISDICTION: With respect to any dispute regarding the Giveaway, your rights and obligations and actions shall be governed by the laws of PA, as if the rules were a contract wholly entered into and wholly performed within PA. Any dispute relating in any way to your participation in the Giveaway shall be submitted to confidential arbitration in PA. Arbitration under this agreement shall be conducted under the rules then prevailing of the American Arbitration Association. The arbitrator's award shall be binding and may be entered as a judgment in any court of competent jurisdiction. To the fullest extent permitted by applicable law, no arbitration under this Agreement shall be joined to or consolidated with an arbitration involving any other party subject to this Agreement, whether through class arbitration proceedings or otherwise.
