SPONSOR: Tomlyn’s “40 Reasons I Love My Pet” Photo Sweepstakes (“Giveaway”) is sponsored by Tomlyn®, the US division of Vetoquinol USA, INC., and distributor of Tomlyn® pet health and wellness products (“Sponsor”). This promotion is in no way sponsored, endorsed or administered by, or associated with Facebook® or Instagram®. By entering, you understand that you are providing your information and image to the Sponsor and not to Facebook or Instagram when entering and when contacted for prize fulfillment. Personal data information will not be shared or sold. Any questions, comments or complaints regarding this Sweepstakes shall be directed solely to the Sponsor.
ELIGIBILITY: The Giveaway is open to legal residents of the 50 United States, including the District of Columbia who are age 18 or older at the time of entry. Void where prohibited by law. Employees of the Sponsor, its parent company, subsidiaries, affiliated companies, advertising and promotion agencies, electronic media firm, RLA Collective. (“Giveaway Administrator”), the immediate families of such employees (employees’ parents, siblings, children and spouses) and members of the same household of such employees, and anyone involved in the production, development or handling of this Giveaway are not eligible. All federal, state, and local laws and regulations apply. By submitting a photograph, the entrant certifies that:
The entrant, if photographed with his/her pet, in the photo is 18 years of age or older at the time of entry;
The entrant owns the copyright to the photograph and agrees to grant the Sponsor exclusive, worldwide, royalty-free, perpetual and irrevocable right and license to copy, reproduce, publish in any media, distribute, and display all submitted photos, images, and text;
Entrant gives the Sponsor permission to contact he/she should he/she be randomly selected;
Entrants must accept this on the Official Entry form to be considered for entry eligibility, but this does not automatically approve the photo entry. The photo submission must also meet our Photo Eligibility guidelines below.
PHOTO CRITERIA/ELIGIBILITY: In order for a photo to be compliant with these Official Rules and support the eligibility of an Entry into the Sweepstakes, the photo:
Must visibly show the entrant’s pet alone or the entrant with his/her pet together;
Must be original;
Must not include people other than the entrant (any group photo or that of a minor with pet are ineligible due to specific privacy laws);
Must not include, without limitation, logos, trademarks, characters, drawings, phrases or other third party products other than Tomlyn pet health and wellness products, that are easily recognizable from the packaging, though inclusion of Tomlyn pet products in the photo is not required;
Photos may not contain, as determined in Sponsor’s sole discretion, any content that:
Is competitive or conflictive with the Tomlyn brand;
Promotes misuse or improper use of a Tomlyn product;
Is considered sexually explicit or suggestive; unnecessary violent or derogatory of any ethnic, racial, gender, religious, professional or age group; profane or pornographic; obscene or offensive;
Is defamatory, threatening, disparaging, or obscene;
Promotes alcohol, illegal drugs, tobacco, firearms/weapons (or the use of any of the foregoing);
Promotes any activities that may appear unsafe or dangerous, promotes any particular political agenda or message;
Is obscene or offensive; endorses any form of hate or hate group;
Defames, misrepresents or contains disparaging remarks about other people, companies, or products;
Contains trademarks, trade names or copyrighted materials owned by others;
Contains any personal identification, such as license plate numbers, personal names (other than just first name), e-mail or street addresses;
Communicates messages inconsistent with the positive images and/or goodwill to which Sponsor wishes to associate;
Contains competitive products;
Violates any law or infringes upon the rights of any other person or company. Photos that do not meet these and other criteria will not be accepted into the Sweepstakes, and entrants of non-eligible/disqualified photos will not be required to be notified that their photo did not meet the criteria for entry.
While winners will be randomly selected, those images that do not meet the overarching theme or photo guidelines will not be considered eligible, hence they will be disqualified. If your photo is disqualified, you can re-enter with a more appropriate image. Images that are accepted should appear on the entry site within 24 hours during regular business days or 48 hours if entered on a weekend. Photos that do not meet these and other criteria will not be accepted into the sweepstakes, and entrants of non-eligible/disqualified photos will not be notified that their photo did not meet the criteria for entry.
The Sponsor and Administrator reserve the right to alter pictures and edit text, and to remove or reject any submissions at any time for any reason. If selected as a random winner, upon Sweepstakes Administrator’s request, the entrant may be asked, upon the administrator’s discretion, to prove ownership of entry photograph by providing to the Administrator two (2) additional images of the subject depicted in the entry photograph within two (2) business days of request. Administrator will contact winner via an email to the email address used to enter the giveaway. If winner does not comply with outlined parameters, their entry will be considered ineligible and a new random winner will be selected from all eligible entries.
HOW TO ENTER: Enter via the sweepstakes microsite link and follow the instructions on how to complete the online entry form.  The microsite link will be accessible from the Tomlyn website (www.tomlyn.com), the Tomlyn Facebook page (www.facebook.com/TomlynPets) and the Tomlyn Instagram channel (www.instagram.com/tomlynpets).
All eligible entries must include a photograph that meets the PHOTO ELIGIBILITYGUIDELINES, include at least one reason why they love their pet, include the official sweepstakes hashtag #TomlynLovesPets, and entrants must fill out the OFFICIAL ENTRY FORM to be considered a formal entry. Use of the hashtag only in social media is not considered an official entry and will not be deemed as an eligible entry. 
Sponsor reserves the right to delete responses that are considered spam and/or are do not meet the PHOTO GUIDELINES. All personal entry information collected on the OFFICIAL ENTRY FORM become the sole property of the Sponsor and will not be shared or sold.
ENTRY PERIOD: The entry period begins on February 20, 2016, at 12:00 p.m. ET and ends March 20, 2016, at 12:00 p.m. ET. Limit of one entry per person, household, or email address. Multiple registrations from the same entrant may result in ineligibility to receive a prize. All entry periods are in Eastern Time unless otherwise noted. 
Administrator’s computer is the official time-keeping device for Sweepstakes. Sponsor is not responsible for incomplete or incorrect mailing addresses or invalid entries.
PRIZES (40 total winners): The first random winner selected of all eligible entries, using an entry randomizer software tool, will be the GRAND PRIZE WINNER of a $500 (US) gift card to one of Tomlyn’s pet health product retailers, along with $100 worth of Tomlyn pet health and wellness products specific to their pet.  An additional 39 entrants will be randomly selected to win a variety of pet-specific Tomlyn pet health and wellness products (ARV $50 US each).
Additionally, if any of the 40 winners have rescued/adopted pets, Tomlyn will send a donation of Tomlyn dog and cat products to the entrant’s shelter of choice if that information is supplied on the entrant’s official entry form.    
Total prize value for all prizes is approximately $2,550 USD, plus shipping and handling depending on winner locations in the United States and not including shelter donations.
Odds of winning depend upon the number of eligible entries received. All prizing offered will be awarded. Any expenses not mentioned above are the winner’s responsibility. If applicable, taxes are the winner’s responsibility. Prizes are not transferable or redeemable for cash. No substitution for prize except as may be necessary due to unavailability, in which case a prize of equal or greater value will be awarded at the Sponsor’s sole discretion. Prizes may vary in size and other respects from items shown on Sweepstakes website. 
WINNERS: Only persons legally residing in the United States who are at least 18 years of age can enter. Winners will be notified via email using the email address on the official entry form and by public announcement on the Tomlyn Facebook page (www.facebook.com/tomlynpets) and Instagram channel (www.instagram.com/tomlynpets), as well as other Tomlyn social/online channels at the Sponsor’s discretion.
No other notification will be provided. 
Winners will be contacted and publicly announced after 12 noon ET on March 22, 2016. Winners can expect to receive their prizes within four (4) weeks following the Giveaway announcement date of 3/22/16 or sooner at Sponsor’s discretion. In the event that a prize notification or prize is returned undeliverable, the prize will be forfeited and, at the Sponsor’s sole discretion, prize may be awarded to an alternate Winner selected in a random drawing from all remaining eligible entries received. Winners will be randomly determined by the Giveaway Administrator, whose decisions regarding this Giveaway are final. Except where prohibited by law, acceptance of a prize shall constitute and signify the winner’s consent that the Sponsor and Tomlyn may use the winner’s name, address (city and state only), likeness and any statements made by the winner about the Giveaway and Sponsor for promotional purposes, in all forms of media, including online on the Sponsor’s website or those operated by the Sponsor now or in the future (e.g. Facebook, Twitter, etc.), in perpetuity and without monetary payment or additional consideration.
GENERAL TERMS: Entrants agree to be bound by these Official Rules. Participants, in this Giveaway, hereby waive and release, and agree to hold harmless Instagram, Giveaway Administrator, Sponsor, its parent, subsidiaries, affiliates, advertising and promotion agencies, and all of their respective officers, directors, employees, representatives and agents, from and against, any and all rights, claims and causes of action whatsoever that they may have, or which may arise, against any of them for any liability for any matter, cause of thing whatsoever, including but not limited to any injury, loss, damage, whether direct, compensatory, incidental or consequential, to person, including death and property, arising in whole or in part, directly or indirectly, from their acceptance, possession, use or misuse of, or inability to use a prize in the Giveaway, or their participation in the Giveaway, or their participation in any Giveaway or prize related activity. Participants acknowledge that the Sponsor and other released entities and individuals have neither made, nor are in any manner responsible or liable for any warranty, representation, or guarantee, expressed or implied, in fact or in law, relative to the prize, including but not limited to its quality, mechanical condition, or fitness, except for any standard limited warranty offered by any manufacturer of the non-cash prize.
INTERNET: Sponsor and its agents are not responsible for lost, late, misdirected, damaged, incomplete or illegible entries or Internet technical, hardware, software, telephone, or transmission failures of any kind, which may limit a person’s ability to enter the Giveaway. Sponsor and its agents are not responsible for any injury or damage to entrants’ or any other person’s computer related to or resulting from entering or downloading any materials in the Giveaway. Sponsor reserves the right to cancel or suspend advertising the Giveaway on the Internet should a computer virus, unauthorized intervention or other cause corrupt the integrity or proper conduct of the Giveaway. Sponsor reserves the right to disqualify any entrant found to be disrupting the operation of the Giveaway or Giveaway Website. If the integrity of the Internet portion of the Giveaway is compromised in any manner, Sponsor reserves the right to modify Giveaway and randomly select winners from valid entries received that are unaffected by the problem. In the event of a dispute as to the identity of any online entrant, entrant will be deemed the individual named on the online entry. All issues and questions concerning these Official Rules, or the rights and obligations of the entrant and Sponsor in connection with the Giveaway, shall be governed by, and construed in accordance with, the laws of the state of TX, without giving effect to any choice of law or conflict of law rules (whether of TX or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than TX.
WARNING: ANY ATTEMPT BY A PARTICIPANT TO DELIBERATELY DAMAGE THE SPONSOR OR SPONSOR’S WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE GIVEAWAY MAY BE IN VIOLATION OF CRIMINAL AND CIVIL LAWS, AND SHOULD SUCH AN ATTEMPT BE MADE, THE SPONSOR RESERVES THE RIGHT TO SEEK REMEDIES AND DAMAGES (INCLUDING ATTORNEYS’ FEES) FROM ANY SUCH PARTICIPANT TO THE FULLEST EXTENT OF THE LAW, INCLUDING CRIMINAL PROSECUTION. APPLICABLE LAWS AND JURISDICTION: With respect to any dispute regarding the Giveaway, your rights and obligations and actions shall be governed by the laws of TX, as if the rules were a contract wholly entered into and wholly performed within TX. Any dispute relating in any way to your participation in the Giveaway shall be submitted to confidential arbitration in TX. Arbitration under this agreement shall be conducted under the rules then prevailing of the American Arbitration Association. The arbitrator's award shall be binding and may be entered as a judgment in any court of competent jurisdiction. To the fullest extent permitted by applicable law, no arbitration under this Agreement shall be joined to or consolidated with an arbitration involving any other party subject to this Agreement, whether through class arbitration proceedings or otherwise.
