Homesalive.ca's "What's Inside Counts" - Official Rules
NO PURCHASE IS NECESSARY to enter this contest, nor will it increase your chances of winning.
Please read these rules before entering the Homesalive.ca's "What's Inside Counts" (the “Contest”). You agree that, by entering this contest, you will be bound by these Official Rules and acknowledge that you satisfy all eligibility requirements. Winning a prize is contingent upon fulfilling all requirements.
Entry Period: The Contest will begin on March 8th, 2013 at 12:01 AM and end on April 30th, 2013 at 11:59 PM (the “Entry Period”). Entries received prior to or after the Entry Period will not be included or accepted.
Eligibility: Homesalive.ca's contest is open only to individuals who are legal residents of Canada, and currently live in Canada. Entrants must be 18 years of age or older at time of entry. Employees of Homes Alive Ltd., Blue Buffalo, and Votigo.com and/or the immediate family (spouse, parents, siblings and children) and household members (whether related or not) of each such employee, are not eligible. The Contest is subject to all applicable Canadian federal, provincial and local laws and regulations. Void where prohibited by law.
Entry Process: During the Entry Period, go to http://www.facebook.com/homesalive, click to “Like” the Homes Alive Facebook page, and then click on the “Contest” link and follow the instructions to submit your entry. One may also enter the contest on a microsite located at http://bit.ly/URULls Limit one (1) submission per user, and 1 vote per user, per photo, per day. The use of any automated processes to submit entries will void all entries submitted by that individual. Homes Alive reserves the right to eliminate any photo for unfair or suspicious voting practices. Photo entries will be approved within 24 hours of entry.
Winning: On or about March 3rd, 2013, Homes Alive will select the name of one (1) potential winner in a random drawing from among all eligible entries received during the Entry Period. The odds of being selected depend on the number of eligible applicants during the entry period. We must receive eligible entries during the Entry Period for them to be eligible for the drawing. The prize will be awarded “AS IS” and WITHOUT WARRANTY OF ANY KIND.
Prize: One (1) winner will be randomly selected to receive a credit of $800 to Homes Alive Pet Centre OR Homesalive.ca to be used toward any purchase at Homes Alive Pet Centre or Homesalive.ca. This is the approximate value of one bag of BLUE (Life Protection Adult) each month for one year. The winner may decide to use the earnings on free food, shipping, or any other merchandise at Homes Alive Pet Centre or Homesalive.ca. Homes Alive Ltd. reserves the right to accept or decline that request of any charity or non-profit based on their sole discretion. Another prize of $150 credit to Homes Alive will be given to the photo with the most votes at the end of the contest period.
Requirements of the Potential Winner: The potential winner will be required to complete and return a statement to prove their eligibility, a release of liability, and, except where prohibited by law, and accept their prize within five (5) days following notice to the potential winner that he or she has been selected. If the potential winner fails to sign and return the statements within the required time period, the prize will be awarded to the runner-up. By accepting a prize, winner consents to the use of his/her name & image for advertising, publicity and promotional purposes by Homes Alive and/or Blue Buffalo, and its designees, including but not limited to the posting of their name or other online announcements, without additional compensation, except where prohibited by law.
About the Credits: Normal Homesalive.ca shipping policies apply to products bought with Contest credits - http://en.homesalive.ca/shipping.aspx. Contest credits can be used to cover shipping charges for any order under $100. Unused Contest credits may not be redeemed for cash. Contest credits may only be redeemed for orders shipped in Canada. Contest credits expire December May 1, 2014. No cash or other substitution may be made, except by Homes Alive Ltd.
Limitations of Liability: Entrant agrees that in any cause of action related to the Contest, the Homes Alive's liability will be limited to $800, and in no event shall Homes Alive or Blue Buffalo be liable for punitive, consequential, or indirect damages. This contest is conducted and directed by Homes Alive Ltd.
Disputes: Except where prohibited, entrant agrees that any and all disputes, claims and causes of action arising out of, or connected with, the Contest or any prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by the appropriate court located in the Lethbridge, Alberta. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, entrant’s rights and obligations, or the rights and obligations of Homes Alive in connection with the Contest, shall be governed by, and construed in accordance with, the laws of Alberta, without giving effect to any conflict of law principles.
General Conditions: We may, to the maximum extent permitted by law, change these rules or cancel the Contest at any time; or modify, terminate, or suspend the Contest should unauthorized human intervention or other causes beyond our control compromising the administration, security, or fairness of the Contest or submission of entries (based on our sole discretion). We are not responsible for: (a) misinformation in any entry, whether it be human or computer error; (b) any printing or typographical errors in the Contest; (c) any error in the operation or transmission, theft, or mishandling of, entries, or for any technical or software malfunctions of any kind, or inaccurate transmission of, or failure to receive any entry information on account of technical problems or traffic congestion on the Internet or at any website; or (d) damage to any computer resulting from downloading any materials in connection with the Contest. We may, in our sole discretion, disqualify any individual found to be tampering with the entry process, acting in a disruptive manner, or negatively affecting the experience of other applicants. The authorized subscriber of the e-mail, Facebook, or Twitter account used to enter the Contest at the actual time of entry will be deemed to be the participant and must comply with these rules in the event of a dispute. If any technical errors occur in the selection of potential prize winner, we may award the prize by random drawing from among all eligible claimants.
Miscellaneous. The Contest is governed by the laws of Canada. If you win a prize, you may not transfer, or redeem the prize for cash. The winner agrees that, by accepting the prize, we will have no liability, and will be held harmless by the winner.
