Official Rules for the “Lightning in a Bottle” Competition:

The Entry Form information you provide will be supplied to the Panelists. We will publish on social media the names of all entrants. The names and generalized idea behind each submission from each of the selected 10 finalists will be announced at the awards ceremony, or published in social, and/or other, media. The Grand Prize winner’s full submission will be announced at the awards ceremony and published in social, and/or other, media. 2013 Revenues will not be published or released to the public, but will be provided to the Panelists for judging purposes.

Eligibility: The Competition is open to any business entity currently engaged in legal business operations within the Philadelphia, Pennsylvania city limits. Employees of ab+c Creative Intelligence and their immediate families are not eligible to participate.

How to Enter: To enter, you must complete the online entry form on the official website: Limit one entry per business. Entries will be accepted from April 14, 2014 to May 19, 2014. Entries must be received by 11:00 pm on May 19, 2014. Our decision as to date and time of receipt is final.

ab+c Creative Intelligence and the Panelists reserve the right, in our sole discretion, to reject and disqualify any entry for any reason. ab+c Creative Intelligence assumes no responsibility for entries it is unable to process due to personnel, network, hardware, technical failures, or lost, or misdirected email entries.

Grand Prize: The Panelists shall select one entrant who shall be offered the Grand Prize. The winner will receive marketing services for one year from ab+c Creative Intelligence valued by ab+c Creative Intelligence at $60,000 based on the then hourly rates of the persons providing the services, plus other services from event partners to be determined. ab+c Creative Intelligence’s services may include branding, market research, social media, creative, public relations, strategic planning, media planning and other valuable services. All third party costs, such as media, printing and production, shall be estimated in advance and subject to approval by the winner. All such costs shall be the winner’s sole responsibility and may require advance payment following winner’s approval thereof. Obviously, success of any marketing campaign cannot be guaranteed. We will work with the winner to determine the best solution to meet their business goals. To achieve the highest likelihood that our services will be successful, we will discuss all elements of our creative services and product, but we will reserve the right to ultimately make the final decisions regarding creative.

Judging Process: All online entries received, unless disqualified, will be reviewed by the Panelists and 10 finalists will be chosen. Those 10 finalists will give a 5-minute in-person presentation to the Panelists on June 6, 2014 at the Greater Philadelphia Chamber of Commerce office. The Panelists will award each finalist 1 to 10 points after judging the submissions. The company with the most points will win the Grand Prize. All decisions made by the Panelists are final, and are subjective.

Idea Submission: By entering the Competition, you agree that your idea may be disclosed, and published, to the public. The Grand Prize winner’s submission and ideas will be fully disclosed; the submissions and ideas of the other 9 finalists will be published and disclosed to the public in more general terms. The submissions and ideas of the non-finalists shall not be disclosed or published. By submitting your idea you grant ab+c Creative Intelligence a non-exclusive, royalty-free, perpetual, irrevocable, and fully sub-licensable right to publish and distribute your submission, and idea, or a portion or distillation thereof, as ab+c Creative Intelligence shall choose, in any form or media, and for its use for public relations, promotional and advertising purposes, including the Internet. Entrants who do not agree to this use should not enter this Competition.
You represent and warrant that you own (if you do not own your submission or idea, you must have the right to submit the content or idea to us without the permission of any third party, and allow our use as intended by this Competition) all the rights to your submission and that you are authorized to grant to us the uses intended set forth herein and that our doing so will not violate the rights of any third party, including trademark, trade secret, patent, copyright or otherwise. You also represent and warrant to us that your submission is accurate; use of your submission does not violate this policy and will not cause injury to any person or entity; and you will indemnify, defend and hold harmless, ab+c Creative Intelligence for all claims resulting from your submission.

ab+c Creative Intelligence reserves the right, in its sole discretion, to cancel the Competition for any reason.

Grand Prize Winner:
The Grand Prize winner will be announced at an award ceremony on or about June 19, 2014.

The Grand Prize winner will be required to sign an Affidavit of Eligibility, Ownership and Release of Liability/Publicity, and Copyright Assignment and License to publish the winning submission, and edited versions thereof, all in form approved by ab+c Creative Intelligence legal counsel, and return these documents within seven days of notification attempt, or forfeit the Grand Prize. If forfeited, or, if the winner declines to accept the Grand Prize, the finalist with the second highest score will become the Grand Prize winner.

By entering the Competition, entrants release ab+c Creative Intelligence, its affiliates, subsidiaries and agents, respective officers, directors, employees, agents and Competition partners from any and all liability or responsibility for any claim arising in connection with participation in the Competition, any prize awarded, any services provided by ab+c Creative Intelligence or your submission.

The Grand Prize winner will be required to sign a Services Agreement with ab+c Creative Intelligence which will govern provision of the Grand Prize by ab+c Creative Intelligence.

ab+c Creative Intelligence is not obligated to publicize the winner and/or its submission.

You must provide to ab+c Creative Intelligence, on request, any information or documentation required to establish your eligibility to enter the Competition, or your ownership of, or ability to license, your submission and the ideas embedded therein.
No purchase is necessary to enter.
The odds of winning cannot be calculated as the odds are dependent on the number of entries received by the Competition and by the quality of, and intrigue generated by, your submission.
Our determination of the winner of the Grand Prize, as well as other decisions relating to the conduct of the Competition shall be final. In the unlikely event of a tie, the Grand Prize may be divided in our discretion.
Neither we nor our agents are responsible for failure of electronic equipment, websites, inability to download entries from website, or other technical difficulty.
If there is a dispute as to the identity of an entrant, we shall be entitled to rely on the name of the company in whose name the entrant’s email account is registered, and that company shall be considered the entrant.
The person entering the Competition on behalf of the company represents and warrants to us he or she is authorized to enter the Competition and make the submission, and understands we rely on this representation and warranty.
This Competition is void where prohibited by law, and where award of the Grand Prize may be unlawful or this Competition must be registered with any authority. That means that if you enter from one of these jurisdictions, you will be treated as not having entered the Competition.
The winner must pay all taxes resulting from the award of the Grand Prize and will be based on the stated value of these services. The winner will be required to provide us with its employment identification number and we will be required to report to applicable tax authorities, including the Internal Revenue Service.
The winning entrant grants to us, or our agent, the right to use its identity and its trade or service marks in commercial advertising and promotion of our services and on our website.
Any disputes regarding this Competition, or the services provided to a Grand Prize winner, shall be resolved solely by binding arbitration held in Philadelphia, Pennsylvania, and conducted by an arbitrator assigned by JAMS. The prevailing party shall recover all costs, including attorneys’ fees.
The Grand Prize winner shall not be entitled to claim any monetary value from the Grand Prize. The services associated with the Grand Prize shall be a winner’s sole award.
